الملخص

فكرة البحث: يعد القانون الدولي من أكثر القوانين احتكاكاً بالسياسة وأشدها تأثراً به بل غالباً ما ينتقد لكونه خاضعاً للسياسة، وذلك يعود لطبيعته وخصوصيته، فهو في تفاعل مع السياسة الدولية التي تمارس وفق اتجاهات حاول الفكر السياسي ان يؤطرها بنظريات كتفسيرات للعلاقات الدولية كالواقعية والليبرالية والبنائية.


هدف البحث: اظهار تأثير النظرية الواقعية على القانون الدولي، وما ينتج عنه من مساس ببنية هذا القانون وعوائق امام تطوره وخصوصاً في قضايا المناخ والقانون الدولي الإنساني والجنائي.


منهجية البحث: تم اتباع المنهج الوصفي والتحليلي لبيان ابعاد العلاقة بين هذه النظرية والقانون الدولي، مع الاخذ بالمنهج الاستقرائي لتتبع بعض تجارب السياسات الواقعية.


النتائج: ان النظرية الواقعية في تضاد مع القانون الدولي فلا يمكن المزاوجة بين السياسة الواقعية والالتزام بهذا القانون، اذ ان عمومية القاعدة الدولية تصبح بلا قيمة اذ يطبق القانون الدولي حسب المصالح وبانتقائية، فلا اساس للالتزام بهذا القانون الا إرادة الدول التي تدور في فلك المصالح.


الخلاصة: ان الواقع يشهد تصاعداً في توظيف النظرية الواقعية في العلاقات الدولية انطلاقاً من تقديم مصلحة الدولة على التزاماتها بالقانون الدولي، وبالتالي هناك تهميش لدور هذا القانون، ويترتب على ذلك اثار سلبية على القانون الدولي والتعاون الدولي.
